These terms cover the NotaLedge app for Android and iPhone, published by ByteHaven Studios LLC, a Wyoming limited liability company ("we", "us"). They're a contract between you and us. By installing or using the app you accept them. If you don't accept them, don't use the app.
What the app does
NotaLedge is an offline income, mileage and expense ledger for mobile notaries, with invoices, tax reports and exports.
Your licence
We give you a personal, non-exclusive, non-transferable licence to use the app on devices you own or control, for as long as you follow these terms and the rules of the store you got it from.
The app, including its code, design, text, images and sound, belongs to us or to the people who license it to us. Open-source components keep their own licences, and those licences win over these terms for those components. Their notices are in the app.
You may not sell, rent or redistribute the app, remove its notices, or use it to break the law or anyone else's rights. You may not reverse engineer it, except where the law lets you and that right can't be given up.
Your content and your data
What you put into the app or work on with it stays yours, and you're responsible for having the right to use it. Keep your own copies of anything that matters.
How the app handles information is explained in the privacy policy, which is separate from these terms.
Purchases and refunds
NotaLedge's core is free. An optional Pro unlock is a one-time purchase, not a subscription.
All sales go through the store you bought from, and that store takes the payment, shows you the price, and applies its own refund rules. We don't see your card details and we can't issue a store refund ourselves.
- Google Play: request a refund through Google Play. Google's refund policy applies.
- App Store: request a refund through Apple at reportaproblem.apple.com. Apple's rules apply.
A purchase is tied to the store account you made it with. Use that same account to restore it on another device.
We may change what's in the free and paid parts of future versions. If we do, what you've already bought keeps working as described when you bought it, for as long as we keep offering the app.
Before you rely on NotaLedge
Not tax, legal or accounting advice. NotaLedge is a record-keeping tool. Its reports, totals and mileage figures are a summary of what you entered, not advice. Check them with a tax professional before you file, and you're responsible for what you file.
Not a notary journal. NotaLedge is a business bookkeeping ledger. It isn't a notarial act register and doesn't replace the record your state requires you to keep.
Your records live on your device. If you lose the device or delete the app without a backup, we can't get them back.
No warranty
We build the app with care and we fix what we can, but we provide it "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the app will run without errors or interruption, or that it will work with every device.
Updates are up to us. We may change or stop offering the app at any time.
Limit on our liability
To the extent the law allows, we aren't liable for indirect, incidental, special or consequential loss, or for lost data, profits or business, even if we were told it might happen. Our total liability for any claim about the app is limited to the greater of what you paid for it in the 12 months before the claim and US$50.
These limits don't apply to liability that can't be limited by law, including fraud and, where the law says so, death or personal injury caused by negligence.
Your rights as a consumer
Nothing in these terms takes away a right the law gives you that can't be waived.
If you live in the European Economic Area or the United Kingdom, you keep every mandatory protection of the law of your country. That includes your statutory rights where digital content isn't as described or doesn't work, and the right to bring a claim in the courts where you live. The "No warranty" and "Limit on our liability" sections apply to you only as far as that law allows. Your right to withdraw from a purchase of digital content can end once the download or use starts, if you agreed to that at checkout.
The same applies to any other country whose consumer law can't be excluded by contract.
Governing law
These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. Any dispute goes to the state or federal courts in Wyoming, unless the section above gives you the right to go to court where you live. Whatever applies to you, write to us first. Most problems get solved that way.
If you got the app from the App Store
If you got the app from Apple's App Store, these terms sit alongside Apple's standard Licensed Application End User License Agreement, and the following applies:
- Who this is with. These terms are between you and us only, not Apple. We, not Apple, are solely responsible for the app and its content. These terms don't set usage rules that conflict with the Apple Media Services Terms and Conditions.
- Licence. Your licence is a non-transferable licence to use the app on Apple-branded products you own or control, as the Usage Rules in the Apple Media Services Terms and Conditions allow. Other accounts linked to the purchaser through Family Sharing or volume purchasing may also use it.
- Maintenance and support. We alone are responsible for any maintenance and support of the app, as these terms say or as the law requires. Apple has no obligation at all to provide maintenance or support for the app.
- Warranty. We alone are responsible for any product warranty, express or implied by law, to the extent it hasn't been effectively disclaimed. If the app fails to meet a warranty that applies, you can tell Apple, and Apple will refund the purchase price, if any. To the fullest extent the law allows, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses from such a failure are ours to deal with, as these terms provide.
- Product claims. We, not Apple, are responsible for dealing with any claim by you or a third party about the app or your having or using it. That includes product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar law. These terms don't limit our liability to you beyond what the law allows.
- Intellectual property. If a third party claims that the app, or your having or using it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- Legal compliance. You confirm that you aren't located in a country subject to a US government embargo or designated by the US government as a "terrorist supporting" country, and that you aren't on any US government list of prohibited or restricted parties.
- Questions and claims. Send any question, complaint or claim about the app to us, using the contact details at the end of these terms.
- Third-party terms. You must follow any third-party terms that apply when you use the app.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right, and is treated as having accepted the right, to enforce them against you as a third-party beneficiary.
Ending these terms
You can stop at any time by uninstalling the app. If you seriously break these terms we may end your licence, and then you must stop using the app. The sections on liability, consumer rights and governing law continue after that.
Changes to these terms
We may update these terms. The current version is always at this address, with its effective date at the top. If a change matters, we'll say so on that page before it takes effect. If you keep using the app after that, the new terms apply. If you don't agree, stop using it.
If part of these terms can't be enforced, the rest still applies.
